Your account consists of your email address is a user ID and password. When you're logged in, you can easily save items and bags, check the status of an order, and more.

Benefits of a virtue customer account

To create an Virtue ID (typically your email address) or sign in using an existing user ID,  Click here (opens in a new window)

If you have made purchases through the Virtue Store, you can use the same Virtue ID you use for either of those. By using your Virtue ID, you can personalize your online shopping experience. You can save items you’re interested in purchasing, save a bag if you’re almost ready to place an order, check the status of or change your order, check Virtue Gift Card balances, and much more.

Guest Checkout

With Guest Checkout, you can purchase items from www.Virtue.love without a Virtue ID or password. Simply add the items you'd like to purchase to your bag, enter your shipping and payment information, and click the Place Order Now button.

To see your full order details, make changes to your order, or cancel or return items, you’ll need to add your order to a Virtue ID.

Adding your guest order to a Virtue ID:

  • Open the order acknowledgement email you received and select the order number at the top to go to your order details.
  • Select the Add to Virtue ID button above your order details.
  • Enter your Virtue ID and password and verify the phone number you used to place the order.
  • You’ll be able to see your full order details and make any changes.

Do I need an account to place an order?

You don’t need an account to complete a purchase. However, if you register with us, you can enjoy the following benefits through your virtue customer account:

Virtue Knitwear is designed to be washed cold and dried under low heat. Virtue straps that include rare earth hardware, which is made with precious metals and stone is designed to be dry cleaned, while the hardware and gems should only be cleaned by professional jewelry cleaners. If you would like to have us repair or clean your Rare Earth Gem Virtue product please email us at hello@virtue.love to setup a maintenance request which offers insuraned shipping and return shipments for a fee.

Payment methods

Virtue accepts a variety of payment methods online. Click on a payment method below to find out more:

  • Note: Business lease, wire transfers, and money orders are ineligible payment methods for pickup items.

Some payment types are ineligible for orders that ship to multiple addresses. If you are using an ineligible payment type for an order shipping to multiple addresses, you will either need to change the payment method or ship your order to a single address.

Using more than one payment method

You can also combine payment methods to pay for your purchase. Choose from the following combinations of credit cards and Virtue Store Gift Cards:

  • Credit card(s) - up to one 
  • Virtue Store Gift Card(s) - up to eight **Available by Summer 2024
  • Virtue Store Gift Card(s) + one credit card  **Available by Summer 2024

During checkout, if you are paying with a gift card issued by a credit card company, you can combine it with one credit card. Valid Visa, Mastercard, or American Express Credit Cards or Debit Cards are accepted.   • If your card is new or recently reissued, make sure it has been activated.
  • Remove dashes or spaces from the account number.
  • If everything seems to be correct, call the card issuer's customer service 800 number on the back of your card. Your credit card company may need to speak with you before they authorize your purchase.

Account verification

To prevent any unnecessary delays in processing your order, please ensure that the billing address on your order matches the information on your credit card account. If you have recently moved or are unsure whether you received your credit card statement at your work or home address, please contact your card-issuing bank using the 800 number on the back of your credit card to confirm.

Security codes

The card security code is a unique three or four digit number printed on the front (American Express) or back (Discover/MasterCard/Visa) of your card, in addition to the account number. American Express has a unique four digit security code while Discover, MasterCard, and Visa has a three digit security code.

Daily spending limits for Debit Cards

Most debit and check cards have daily spending limits that may substantially delay the processing of an order, even if there is enough money in an account. When using a debit card, funds are immediately reserved in your bank account at the time you place your order. Please consult your card-issuing bank for information about your daily spending limits if you are having trouble placing your order.

When Virtue charges your account

When you place an order, Virtue will contact your credit or debit card's issuing bank to confirm it is a valid account. Virtue requests authorization, which holds the funds for the full or partial purchase amount. As Virtue prepares your items, authorized funds will be unavailable and may display as "pending" on your credit or debit card's online statement.

If you are shipping an item, your card will only be charged after the item has shipped.If your order contains multiple items, you may see multiple charges on your credit or debit card statement.

If you cancel your order before your items are billed, any authorizations placed on your credit card account can take up to 30 days to expire and any authorizations placed on your debit card account can take up to 10 days to expire. Contact your financial institution for their specific timeframes.

If you are paying for your order with an international Visa, MasterCard, or American Express, please note that the purchase price may fluctuate with exchange rates. In addition, your bank or credit card issuer may also charge you foreign conversion charges and fees, which may also increase the overall cost of your purchase. Please contact your bank or credit card issuer regarding these fees.

Any gift card issued by a credit card company can be used as a method of payment when buying from virtue.love. During checkout, if you are paying with a gift card issued by a credit card company, you can combine it with one credit card.

PayPal

When you place an order with PayPal you will be redirected to the PayPal website. There you will then need to login with your PayPal username and password.

If your order consists of multiple deliveries, your PayPal account will be charged separately for each shipment.

 

Virtue Store Gift Card **Available by Summer 2024

You can redeem a Virtue Store Gift Card at any Virtue Store, or by purchasing products online from Virtue.love. Virtue Store Gift Cards can be used only in the United States.

You can use up to eight Virtue Store Gift Cards at a time when you purchase online from Virtue. You can combine your Virtue Gift Card(s) with one credit card to pay for your purchase. Simply enter or provide the PIN. On the electronic Virtue Gift Cards, the PIN can be found on the email below the image of the card. Please keep the digital card in your possession until the order has been processed and delivered.

Tax/ Tax rate

In accordance with local, state and international law, your online purchases from Virtue will be taxed using the applicable sales tax or seller's use tax rate for your shipping address.

Your invoice will reflect the final total tax, which includes state and local taxes, as well as any applicable rebates or fees.

Placing a direct order is easy, simply click buy on any products featured on the official Virtue website. All pre purchased items will be displayed in the shopping cart, ready to be processed with an email address that will be matched with the product’s blockchain number.

To properly place a gift order, please make sure to include a current email address belonging to the individual you will be gifting. 

 

Check Order Status

If you have a virtue customer account, it is easy to check the status of your order. First, visit your Order Listing page and enter your Virtue ID and password. Once you sign in, select an item to view your order details.

On your order details page, a progress bar and status message display next to each of your items. Status messages include:

  • Order Placed — We’ve received your payment and order information and will start preparing your item shortly.
  • Processing — Once your item is ready, we’ll send you an update and prepare the shipment. 
  • Preparing to Ship — We’re completing a few final details before shipping your order. As soon as it ships, we’ll email you the delivery information.
  • Shipped — Your item is on the way. Tracking information will be available within 12-24 hours.
  • Delivered — The package has been delivered to the shipping address specified in your order.

If you do not have a Virtue ID you should expect to receive email updates regarding your order status, if you have not received any emails please contact us at hello@virtue.love so we may investigate the issue and resolve it. Please ensure to share the email you used to place the order so that we may identify the order in the event there were any typos when the order was placed.

Track Your Order/ Track Shipped Items

For items shipped to a physical address, you'll receive a shipment notification email with your carrier information, and estimated delivery date and, if available, a tracking number.

You can also view shipping information by selecting an item from your Order Listing page if you have created a Virtue customer account. There you’ll see the most recent delivery estimates, as well as a Track Shipment link to detailed tracking information on the carrier’s website. If you ordered multiple items, you may have separate tracking information for each item.

To ensure safe delivery, some shipments require a signature on delivery. If your delivery requires a signature and you won’t be available, you can use the “Pre-sign for delivery” link to authorize the delivery with the carrier ahead of time. Refer to the Shipping & Pickup help page for more information.

 

What to Expect

Once your order ships, or is available for pickup, we'll send you an email. The email message will include your order number and a link to the tracking information. We also send emails on the day of delivery or after your item has been delivered, depending upon your shipping method, country, and carrier. You may receive between 1-3 email messages per shipment on your order.

How to change text message preferences

You can edit your email address at any time by signing into your account and editing the shipment notification preferences for your order. Refer to the Shipping & PickUp help page for more details.

Shipping is free on all orders. At Virtue, we use the best carriers in the business to make sure your order gets to you on time. From the Secure Checkout page you'll see your item description, price and estimated delivery date.

Guaranteed shipping services

Where available, you can also choose a faster delivery method for each item on your order, for an additional fee: Delivery times vary according to your selected delivery address, availability of your items and the time of day you place your order. A signature may be required for delivery.

 

Ships Time

The ‘Ships‘ time is an estimate of when the item will leave our warehouse. For example, if an item displays "Ships: 1 business day" the item will leave our warehouse 1 business day after you place your order. While Virtue works hard to ship every order as quickly as possible, personalized, custom-configured, and more popular items may have longer ship times.

Occasionally, we will confirm ship and delivery times, then learn we are unable to fulfill the order due to low product availability. In these rare cases, we will notify by email of the new ship and delivery times.

 

Shipping Cost

The cost for shipping is calculated and displayed on the Checkout page before you complete your order. Courier Delivery cost includes tip. You can find delivery costs at checkout, on the Order Confirmation email and online when you view your order on the Order Status website.

 

What's Next?

Once your order is placed, we send information about your order by email. The email you receive depends on whether you chose to have the items delivered or picked up. If you have multiple items on your order, you may receive additional emails for each item.

 

Order Acknowledgement

The order acknowledgment email provides a summary of the items in your order. If you choose to have an item delivered, the order acknowledgment will display the delivery address and delivery date. You can click the date to view your order details. For pickup items in your order, the email will display your selected Virtue Store location. If you have designated someone else to pick up the item for you, the email will also display your pickup contact.

 

Shipment Notification

If you choose to have an item delivered, we'll send a shipment notification email when the item leaves our warehouse. This email includes the carrier name, tracking number, and delivery date. You can click the tracking number to track your package using Virtue's online Order Status or enter the tracking number on the carrier's website. If you purchase a Virtue Gift Card by email, we'll send you an email notification once we send the gift card to the recipient.

 

Text Notifications

We send updates by text message, so you can stay updated on your delivery or pickup order. Just add your email address at checkout to receive these notifications. The number of emails you'll receive will vary depending on the orders you placed.

 

What to Expect

Once your order is shipped, we'll send you an email. This will include your order number and a link to the tracking information. We will also send you emails on the day of delivery or after your item has been delivered, depending on your selected delivery method, country and carrier. You may receive 1-3 email messages per item on your order.

 

Changing Text Message Preferences

You can edit your mobile phone number at any time by signing in to your account and editing the delivery or pickup notification preferences for your order. Your privacy is important us at Virtue. Carrier Delivery Options

Virtue chooses which carrier will deliver your shipment, and some of our shipments require a signature. Your Shipment Notification email will tell you whether a signature is required. The carrier may also require a signature at their discretion. The carrier may make subsequent delivery attempts before returning the shipment to Virtue. Once your order has prepared for shipment or has shipped, we are unable to change the shipping address.

If you are unavailable to provide a signature, Virtue offers two easy options for you to receive your package.

 

Option 1: Sign the Delivery Notice to release your shipment to your address, an immediate neighbor, or a building manager. If you were unavailable to receive delivery, the carrier will leave a Delivery Notice on your door after the first attempt. You can sign the Delivery Notice, specify a preferred delivery location (e.g., front door, back door, immediate neighbor, building manager), and leave the notice on your door prior to the next delivery attempt. If you provide an address other than the one specified on the package, someone must sign for the package.

 

Option 2: Pick up package at carrier's local facility

After the first delivery attempt, you can request to pick up your package at our carrier's local facility. Call the number on the carrier's Delivery Notice and inform them you'd like to pick up your package in person.

 

To pick up your package from the carrier's local facility, you may need:

  • The Delivery Notice
  • Government ID (driver's license, passport) that matches the package name and address
  • Second ID with your name on it (credit card, social security card)

The carrier can release the package only to the person included on the shipping address.

In addition to these options, our carriers may offer additional delivery options, which may include electronic signature or estimated delivery time windows, learn more at FedEx Delivery Manager and UPS MyChoice.

 

Shipping in the U.S.

Items purchased online from Virtue ship within the continental US, Alaska, Hawaii and Puerto Rico. No shipments can be made to P.O. Box addresses, United States territories, or addresses outside of the United States. You may not export any products purchased online from Virtue.

 

We are happy to ship your order to a friend or family member residing within the 50 United States if your billing address is within one of the following United States territories: American Samoa, Armed Forces Africa, Armed Forces Americas, Armed Forces Canada, Armed Forces Europe, Armed Forces Middle East, Armed Forces Pacific, Guam, Northern Mariana Islands, Palau, and U.S. Virgin Islands.

Simply shop virtue.love with the payment method of your choice, and we'll ship the order to any address within the 50 United States. Returns and Refunds

 Virtue returns may be processed for product that meet our return policy, please note that returns are valid 30 days from your product delivery arrival. Virtue only accepts returns on unopened, unworn, unwashed and unaltered products due to hygiene policies and US laws. To return or exchange by mail, please follow these instructions:

If you signed up for a Virtue customer account, please login to your account, click on the specific order number that you would like to return. You online account will showcase all the products ordered and allow you to select specific products for return.

If you did not sign up for a Virtue customer account you can access your order by visiting virtue.love/triotrak and entering your order number, email address, and name to ensure we can securly access your account and order details and ensure we protect you and our other customers information.


When shipping back returned items please ensure that you securely packing your Virtue merchandise, making sure to include all pages of the packing slip. Please use the original shipping box and materials if possible. Virtue does not accept the return of opened box undergarments due to hygiene policies and US laws. Ensure that you affix the pre-addressed and pre-paid return label to your return package.

RETURNING A GIFT

Gifts can be returned or exchanged by mail when accompanied by the gift receipt or original packing slip. If you’re unable to process an online return or online exchange and require our assistance to complete a return by mail, please email a customer service representative to obtain a prepaid shipping label at hello@virtue.love

FINAL SALE ITEMS

We do not accept returns or exchanges of items that were purchased on sale. Virtue reserves the right to modify its return and exchange policy at any time.

SHIPPING TERMS

You can track your order at any time online via your Virtue customer account. To access any order or return details, you will need to enter your name, email address and order number. You also can track your order by clicking on the tracking link included in your shipping confirmation email, or by emailing a customer service representative at hello@virtue.love

 

Viewing and Changing Orders

View Your Order

Sign into your Virtue customer account and view your Order Listing Page to view your purchased or saved products.

 

Edit Your Order

Sign into your Order Listing page and select an item to view your order details. You may be able to edit the item if the status reads Order Placed or Processing. If you placed an order as a guest, you’ll need to add it to your Virtue ID to make changes online.

 

Edit Shipping Address

If your order is in Processing, you may be able to edit your shipping address in your order details. In the “Delivers to” section below your item, select Edit.

To edit your default shipping address for future orders, select Shipping and Billing in the Settings section on the Your Account page.

 

Edit Email Address

If you didn’t receive an order acknowledgment, pickup, or shipment notification email, we may have an incorrect email address or the emails might be stuck in your spam or junk mail folder. You can update your email address for an order by selecting Edit in the order details under the Contact Information section.

To edit your default email address for future orders, select Shipping and Billing in the Settings section on the Your Account page. If you need help with viewing or editing your order, please email us at hello@virtue.love.

 

Canceling Your Order

If your item is in Processing, you can cancel it online if you have a Virtue customer account before it ships. Go to your Order Listings page and select an item to see your order details, then select Cancel Item. Once you’ve submitted your cancellation request, the status message of that item will read Canceled or Pickup Canceled. If you canceled an item that was shipping to a physical address, you will not be billed for your item. If you canceled a pickup item, you may have been billed. We will initiate your refund immediately after you submit your cancellation request.

If you are unable to cancel your item online, you may be able to return it. To see if your item is eligible for a return, refer to the Returns & Refunds help page or speak with an Virtue Specialist by emailing customer service at hello@virtue.love.

Except for your Submitted Information and Materials (as defined in Section 1.5 below), we and our licensors own, solely and exclusively, all rights, title and interest (including, without limitation, copyrights) in and to the Sites, all the content (including, but not limited to, all illustrations, renderings, drawings, images, photographs, audio, podcasts, video, Webcasts, RSS feeds, graphics, logos, iconography, symbols, widgets, gadgets, concepts, other distributable applications, other visuals, copy and software), code, data, blockchain and other materials thereon (collectively, the “Site Content”), the look and feel, design and organization of the Sites, the compilation and organization of the Site Content, including but not limited to any copyrights, trademark rights, patent rights, database rights, moral rights, and other intellectual property and proprietary rights therein. Your use of the Site does not grant to you ownership or title of, in or to any Site Content or any other part of the Site, nor does it grant you any license to use, feature, or display the same except as expressly permitted and authorized herein.

1.2. Limited License. Subject to these Terms, we grant to you a non-exclusive, non-transferable, limited license to access, view, use and display the Sites and Site Content on your computer or other device, provided that you comply fully with these Terms. The Sites and Site Content are for your personal, educational and non-commercial use only. No part of the Sites or Site Content (or any of our products advertised or sold on the Sites) may be copied, reproduced, republished, exploited, posted, uploaded, downloaded, transmitted, modified, altered, derived, distributed or used in any manner whatsoever, without our prior written consent or that of the applicable rights owner, except for limited personal, non-commercial or educational purposes as permitted under the law.

1.3. Trademarks. The trademarks, logos, service marks and trade names displayed on the Sites or as part of the Site Content (including, without limitation, Virtue, AIRCARBON, NEWLIGHT, etc.) are registered and unregistered trademarks of the COMPANY and other persons (collectively, the “Trademarks”), and may not be used unless expressly authorized by the applicable Trademark owner. Nothing contained on the Sites should be construed as granting, expressly, by implication, estoppel, or otherwise any license or right to use any Trademark displayed on the Sites or as part of the Site Content, without our written permission.

1.4. Material Submission. Unless specifically requested of us, we neither solicit nor wish to receive any confidential, secret or proprietary information or other material from you. Any information, concepts, ideas, documents, pictures, images, drawings, renderings, photographs, designs, creative works, requests, proposals, letters, demos, know-how, suggestions, methods, systems, plans, techniques, comments, criticisms, feedback, reports, reviews, ratings, or other materials submitted or transmitted through the Site in any manner, including, but not limited to, through the “Contact Us” section (collectively, “Submitted Materials”) will be deemed not to be confidential, secret or proprietary and may be used by us in any manner consistent with these Terms.

By submitting, uploading, posting or sending Submitted Materials to, on or through the Sites, you: (i) represent and warrant that either (A) your Submitted Materials are original to you and that no other party has any rights thereto, or (B) that you have the necessary rights, licenses, consent, and permissions to use such Submitted Materials and submit them to the Sites for our use, in accordance with these Terms and with any purposes that may be described on the Sites, and that any “moral rights” in the Submitted Materials have been waived; and (ii) you grant to us (and our affiliates) an unrestricted, royalty-free, worldwide, perpetual, irrevocable, non-exclusive and fully transferable, assignable and sub-licensable right and available for license to use, reproduce, copy, modify, alter, store, adapt, translate, create derivative works from, distribute, perform, display, make, publish, export, exploit, sell, or incorporate such Submitted Materials (in whole or in part) in other works (including, without limitation, the Sites), products or services, in any form, technology or media, now known or later developed, and for any purpose. We are not responsible for maintaining or storing Submitted Materials and may delete or destroy, any Submitted Material that you provide. You represent and warrant that your Submitted Materials comply with these Terms, and you agree to keep all necessary supporting documentation, and to make such records available to us upon our request.

1.5. Editorial Control and Right to Monitor. We may (but have no obligation to) monitor, review, or store anything submitted on the Sites. We neither endorse sponsor, control, nor bear responsibility for any such materials. However, we may disclose or share any information or materials (including your Submitted Materials) as necessary to satisfy any regulation, law or government request, or we may edit, refuse to post or remove any such content, in whole or in part, which violate these Terms, our policies or applicable law, or which in our sole discretion are objectionable. Using the Sites may expose you to content of others that may be offensive, indecent, or objectionable to you, and we are not liable for such content.

2.1. User Accounts. Using certain features on the Sites may require creating an account (“Account”) and submitting personal information (including creating a username, password, email address, and other details that could be used to access the account). The Site’s information collection and use policies are set forth in the Site’s Privacy Policy , which is incorporated herein by this reference. You agree to submit only true, accurate, current and complete information, and you accept all responsibility for any and all information, all activities, and all interaction that occur under your Account. We are not under any obligation to verify the actual identity or authority of any person using or accessing your Account. We reserve the right, in our sole discretion and without notice to you, to suspend or terminate your Account or to restrict your access to all or part of the Sites for any reason.

2.2. Rules of Conduct. While accessing or using the Sites, the Site Content and the various other features available on the Sites (such as the Forums, as defined below), you warrant and agree that you shall not: 

  • violate any law, rule or regulation; 
  • violate the security of the Sites, or obtain or attempt to gain unauthorized access to the Sites, Site Content, computer systems, tracking systems, blockchain, or networks connected to any server associated with the Sites or the Site Content;
  • impersonate any entity or person, whether actual or fictitious, including anyone from the Sites or the Company, or misrepresent your affiliation with any other person or entity;
  • harass, stalk, or harm another individual;
  • insert your own or a third party’s branding, advertising, or any other promotional content (including, without limitation, hyperlinks) into any of the Site Content or services on any Site, or into any of your Submitted Materials that you may submit to any Forum or any other areas of the Sites;
  • use, post, upload, transmit, distribute, publish, reproduce, or in any way exploit any part of the Sites or any Site Content for any commercial or promotional purposes (other than as expressly permitted in a signed writing by the provider of such information or other materials), or contact any other user of the Sites for commercial or promotional purposes, or offer to sell, distribute, buy, or purchase any product or service through your activities on the Sites or in a Forum;
  • alter, edit, remove, delete, fail to display, otherwise change the meaning or appearance of, or repurpose any of the Site Content, including, without limitation, any logos, symbols, icons, visuals, graphics, designs, trademarks, trade names, service marks, promotional taglines, or any other proprietary content or proprietary rights notices included therein or thereon;
  • engage in spidering, “database scraping”, “screen scraping”, harvesting of email addresses or other personal information, or any other automatic or unauthorized means of accessing, logging-in or registering on the Sites, or obtaining lists of users or other information through the Sites, including, without limitation, any information residing on any database or server connected to the Sites; 
  • use the Sites or their features in any manner that could damage, disable, interrupt, overburden or impair the Sites or such features, or interfere with any other party's use and enjoyment or use of the Sites, including, without limitation, sending a mass unsolicited message or unauthorized advertising or commercial communications, or “flooding” servers with requests; 
  • reverse engineer, decrypt, or otherwise alter or interfere (or attempt, encourage or support anyone else’s attempt to do any of the foregoing) with the Sites or its services, software or code on the Sites;
  • create any links from the Sites (or include any links in your submissions to any Forum or any other part of a Site) directed to websites or content owned or maintained by third parties;
  • Portray or otherwise frame any third-party sites or content in any manner that would constitute or could be interpreted as an endorsement or sponsorship by us of any third-party site, content, information or other materials, or in any manner that would violate the terms and conditions of any such third-party sites;
  • Publish, post, upload, transmit or otherwise distribute to, on or through the Sites, any information, materials or content which are false (including statements or materials that constitute or contain false or misleading indications of origin, endorsements, or statements of fact), unlawful, fraudulent, misleading, abusive, threatening, harassing, harmful, hateful, ethically, racially, or otherwise libelous, objectionable, defamatory, vulgar, obscene, pornographic, offensive, profane, indecent or sexually explicit or, including without limitation, any material which encourages or constitutes conduct that would allude to a criminal offense, give rise to civil liability or otherwise violate any local, state, national, or international law;
  • use the Sites or the Site Content to, or in any other manner, plagiarize, infringe or violate the rights of third parties, including without limitation, trademark, copyright, trade secret, confidentiality, contract, patent, rights of publicity or rights of privacy, or any other proprietary or legal right;
  • distribute, upload, post, publish, share or otherwise transmit any information or material which constitutes or contains a spyware, virus, algorithm, or other harmful component, or which contains any advertising, branding, embedded links, chain letters or pyramid schemes of any kind; or
  • use the Sites or their services (or any Site Content), in whole or in part, for any purpose that is prohibited by any applicable law or regulation, or to facilitate the violation of any applicable law or regulation.

2.3. Public Forums.  The Sites may include features allowing users to communicate with each other or the general public (such as messaging services, chat services, blockchain, bulletin boards, message boards, ratings and reviews, blogs, social media outlets, and other similar forums, areas, and services) (collectively, the “Forums”). These Terms apply to your use of the Forums as part of the Sites. Given the open nature of the worldwide Internet, you should be careful and selective about the information you disclose and share in the Forums and on the Sites and, in particular, you should not disclose any sensitive, personal, proprietary or confidential information.

2.4. Indemnification.  You agree to defend, indemnify and hold us and our officers, directors, employees and agents harmless from any and all damages, claims, liabilities, costs and expenses, including, but not limited to, reasonable attorneys' fees, arising from (i) your use of the Sites or the Site Content in violation of any law, rule, regulation or these Terms, or (ii) any part of your Submitted Materials. The Company may, but is not obligated to, assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to fully to cooperate with any such defense.

3.1. Orders and Returns. You may order products from the Sites only if you have reached the age of majority in your jurisdiction. You agree to pay in full the prices for your purchases, plus any applicable taxes. Certain products and services that you may be able to purchase or download through the Sites may be subject to additional terms and conditions presented to you during such purchase, lease, and or download. By ordering products from the Sites, you agree that you are bound by and have rights under these Terms as well as our Privacy Policy, our Shipping Policy, our Payment Policy our Return and Exchange Policy and our Warranty Policy, which are incorporated by reference into these Terms.

We reserve the right to refuse any order you place through the Sites. We may, in our sole discretion, limit or cancel quantities of products purchased per person, per household or per order. These restrictions may include orders placed by or under the same Account, the same credit card, the same email address, or orders that use the same promotion code, billing or shipping address. In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the email and phone number provided at the time the order was made. Prices displayed on virtue.love are quoted in USD and are valid and effective only in the U.S.

3.2. Promotions. The Sites may contain sweepstakes, contests or other promotions requiring you to send materials or information to us (and sometimes others). Such sweepstakes, contests or promotions may be governed by a separate set of rules, policies and terms. It is your responsibility to read such rules, policies and terms to determine whether you can participate, register and comply therewith. By participating in a sweepstakes or contest through the Sites, you signify your agreement and acceptance of these Terms and any applicable sweepstakes or contest rules which we may provide.

3.3. Pricing and Other Errors. We have made every effort to display as accurately as possible the colors and features of our products on the Sites. However, the particular technical specifications, displays and settings of your electronic device could affect the accuracy of the portrayal of our devices. We are not responsible if information made available on the Sites is inaccurate, incomplete or not current.

From time to time, information on the Sites might contain typographical or visual errors, inaccuracies, or omissions that may relate to product descriptions, pricing or availability. It is your responsibility to monitor changes to the Sites. Any reliance on the information on the Sites is at your own risk. Prices and availability of products and services are subject to change without notice. We reserve the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged and we cancel your order, we will issue the credit to your credit card. Individual bank policies dictate when this amount is credited to your account.

3.4. Site Links. We disclaim all responsibility for any viruses or malicious code that may appear on any Linked Sites, for the accuracy of any of the information they provide and for any goods or services provided by or purchased from such Linked Sites. 3.6. Third-Party Providers & App Stores. Certain third-party providers, whose devices and/or operating systems our mobile applications have been designed to be compatible, oblige us to include certain additional provisions in these Terms. These are set out at the end of these Terms in Section 6.2.

Third party application stores are operated by the relevant third-party providers and their affiliates. You must comply with all applicable terms of service, rules and policies applying to any third-party application store from which you download any mobile applications. We are not responsible for these stores for anything provided by them and do not guarantee that they will be continuously available.

4.3. Jurisdictional Issues. The Sites are intended for users located in the United States of America. We generally control and operate the Sites from our offices in the United States. 5.1. Termination. We may terminate, change, suspend, restrict or discontinue any aspect of the Sites at any time if we believe you are in breach of these Terms or applicable law, or for any other reason in our discretion, without notice or liability. These Terms will terminate commensurate with the discontinuance or termination of your Site use privileges. However, the Terms will nevertheless continue to apply and be binding upon you and any persons you represent, jointly and separately, regarding your prior access to and use of the Sites and Site Content, and anything connected with, relating to or arising therefrom.

5.2. Miscellaneous. These Terms, as may be amended from time to time, including the terms and conditions of any other policies the Terms link or refer to, constitute the entire agreement between you and the Company with respect to the access to and use of the Sites and the content. These Terms and the relationship between you and us shall be governed by the laws of the United States and the State of California, without regard to its conflict of law provisions. Any cause of action arising under the Terms shall be commenced and be heard in the appropriate court in the State of California, County of Orange. Subject to Section 6.1 below, you agree to submit to the personal and exclusive jurisdiction of the courts located within Orange County in the State of California. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the Terms shall remain in full force and effect. All provisions of these Terms that consist of or relate to notices, ownership of intellectual or other property, representations, warranties, limitations of liability, disclaimers, indemnification, governing law, venue or jurisdiction, or any prohibitions or restrictions respecting any access to, use of, or other activities concerning the Sites or any Site Content, shall survive the revocation, expiration or termination, in whole or in part, of these Terms. We reserve all rights not expressly granted in these Terms. The parties have expressly requested and required that these Terms and all other related documents be drawn up in the English language.

5.3. Notices of Claimed Copyright Infringement. We respect the intellectual property rights of others and require that users of the Sites do the same. We also maintain a policy that provides for the termination in appropriate circumstances of the Sites’ use privileges of users who are repeat infringers of intellectual property rights. If you believe that your work has been copied in a way that constitutes copyright infringement, please forward the following information to our Copyright Agent, designated as such pursuant to the Digital Millennium Copyright Act, 17 U.S.C. § 512(c)(2) (the “DMCA”), named below:

6.1. Disputes. You agree that any dispute or claim arising out of your use of the Sites or any products sold on the Sites, including any dispute or claim as to the application, enforceability, scope, or interpretation of this agreement to arbitrate, shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to these Terms of Use.

There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief, or statutory damages), and must follow these Terms of Use.

Arbitration shall be administered by the Judicial Arbitration and Mediation Services, Inc. (“JAMS”), pursuant to the JAMS Streamlined Arbitration Rules & Procedures effective July 1, 2014, and conducted by a single, neutral arbitrator. Arbitration shall take place by phone, unless an in-person hearing is requested by either party. In that case, the hearing shall take place in the county where you reside. To the extent this agreement to arbitrate conflicts with the JAMS Policy on Consumer Arbitrations Pursuant to Pre-Dispute Clauses Minimum Standards of Procedural Fairness (the “Minimum Standards”), the Minimum Standards in that regard will apply. Disputes may also be referred to another arbitration organization if you and the Company agree in writing, or to an arbitrator appointed pursuant to Section 5 of the Federal Arbitration Act. To start an arbitration proceeding, you must execute and serve a Demand for Arbitration on the Company by mailing it to insert address pursuant to the JAMS instructions. The Company will bear the reasonable cost of your initial filing fee.

We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, we each expressly waive any right to a jury trial. We also both agree that you or we may bring suit in court to enjoin infringement or other misuse of intellectual property rights.

6.2. Third-Party Provider Terms. If the mobile application that you download, access and/or use runs on Virtue's iOS operating system or our partners’s Android operating system:

  • The mobile application may only be accessed and used on a device owned or controlled by you which uses Virtue's iOS operating system or our partners’s Android operating system, and only in accordance with Virtue and our partners usage rules published in its Website and App Store terms of service;

  • You acknowledge and agree that:
-Virtue have no obligation at all to provide any support or maintenance services in relation to Platform. If you have any maintenance or support questions in relation to the mobile application, please contact us, not Virtue or our partners, using the contact details set out in Section 6.3 of these Terms; 
-except as otherwise expressly set out in these Terms, any claims relating to the possession or use of the mobile application are between you and us (and not between you, or anyone else, and Virtue or our partners); 
-in the event of any claim by a third party that your possession or use (in accordance with these Terms) of the mobile application infringes any intellectual property rights, Virtue or our partners will not be responsible or liable to you in relation to that claim; and

-although these terms are entered into between you and us (and not Virtue or our partners), Virtue and, or our partners, as a third party beneficiary under these terms, will have the right to enforce these terms against you;

  • You represent and warrant that: (a) you are not, and will not be, located in any country that is the subject of a United States Government embargo or that has been designated by the United States Government as a "terrorist supporting" country; and (b) you are not listed on any United States Government list of prohibited or restricted parties; and
  • If the mobile application does not conform to any warranty applying to it, you may notify Virtue or our partners, which will then refund the purchase price of the mobile application (if any) to you. Subject to that, and to the maximum extent permitted by law, Virtue or our partners do not give or enter into any warranty, condition or other term in relation to the mobile application and will not be liable to you for any claims, losses, costs or expenses of whatever nature in relation to the Platform or as a result of you or anyone else using the mobile application or relying on any of its content.
